To be eligible for the H-1B lottery, a complete application must be filed with the immigration service. So, the necessary I-129 forms, the supplements, the data collection sheets, filing fee, etc. must be filed. There is also a Labor Condition Application that also must be submitted. This is something that is actually filed with the U.S. Department of Labor and not the U.S. Citizenship and Immigration Services (USCIS) . If any of the required documents or fees are not submitted at the time of filing, an employer’s petition can be rejected and will not be allowed into the lottery.
