On March 16, 2022, the Board of Immigration Appeals (BIA or Board) welcomed interested members of the public to file amicus curiae briefs discussing what factors the Board should weigh when considering an untimely motion to reopen that is based on the vacatur of a criminal conviction. Those wishing to appear as amicus curiae are instructed to submit a Request to Appear per Chapter 2.10, Appendix B (Directory), and Appendix F (Sample Cover Page) of the BIA Practice Manual, explicitly identifying Amicus Invitation No. 22-16-03.
Briefs must be filed in conjunction with the Request to Appear, identifying the Amicus Invitation number and presenting relevant legal arguments. Briefs are limited to 25 double-spaced pages. Requests to Appear and briefs must be filed with the Clerk’s Office by April 6, 2022. Amici are requested to mail three copies of each Request to Appear and brief. There is no fee for filing.
