On October 12, 2018, Attorney General (AG) Jefferson Sessions issued an order noting that he had previously, on September 18, 2018, directed the Board of Immigration Appeals (BIA or Board) to refer a case to him for review. As the respondent has been removed “pursuant to a final order of removal”, he or she is no longer in the U.S. so AG Sessions announced that he no longer plans to “review the Board’s determination that the respondent was eligible to be released on bond.” He thus remanded the case to the BIA for any further administrative action deemed necessary.
