If someone is already in the process of getting a visa, green card or becoming naturalized, is it possible to change the laws midstream or are they protected by changes in the law?
You would like to think no, but it remains to be seen whether these applicants will be considered to have an invested right that can’t be taken from them, or whether the employer has a right that can’t be taken.
Whether President Trump is able through an Executive Order, with the cooperation of the Republican-dominated Congress, can change the rules so as to include people who have already submitted their applications and are merely awaiting their date to become clients and pick up their green card remains to be seen.
