Can President Trump make changes in immigration law through executive orders or does need cooperation from congress?
The President does have some power through executive order, but if he is going to try and change anything that is in the statute or in the regulations, we believe that he has to go through the normal rule making process. For example, changes to regulations must go through a formal notice and comment period. Of course, statutes must be negotiated and approved by Congress.
It’s going to be very hard for him to try and change rules of law and regulations without going through major congressional and judicial hurdles, but it’s expected that the President is also going to try to circumvent the rules making process, at least by trying to effect executive orders.
